Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by SitePilot Solutions ("we," "us," or "our"). By using our website, submitting a contact form, or purchasing services, you agree to these Terms. If you do not agree, please do not use our services.
1. Services
SitePilot Solutions provides website design, website development, search engine optimization (SEO), website maintenance, hosting support, and related digital services ("Services"). Project scope, deliverables, timelines, and fees are described in the proposal, invoice, or service agreement agreed to before work begins.
2. Acceptance of Terms
By accessing our website at sitepilot.solutions, requesting information, or engaging our Services, you represent that you are at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the entity you represent.
3. Quotes, Payments, and Refunds
Project pricing is based on the scope outlined in your proposal. A deposit may be required before work begins. Recurring services, such as Website Care Plans, are billed in advance on a monthly basis. Fees are non-refundable except where required by law or expressly stated in your service agreement.
4. Client Responsibilities
You agree to provide timely access, content, feedback, and approvals needed to complete the project. Delays caused by missing client materials may extend delivery timelines. You represent that any materials you provide do not infringe on the rights of third parties.
5. Intellectual Property
Upon full payment, you own the final website design and content we create specifically for your project, excluding third-party materials, stock assets, open-source libraries, or our pre-existing templates and tools. We retain the right to display completed work in our portfolio unless otherwise agreed in writing.
6. Third-Party Services
We may use third-party platforms (for example, hosting providers, domain registrars, analytics tools, and email services) to deliver our Services. Your use of those services is also subject to their respective terms and policies. We are not responsible for outages, changes, or discontinuation of third-party services.
7. Limitation of Liability
To the fullest extent permitted by law, SitePilot Solutions is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue, arising from the use of our Services. Our total liability for any claim will not exceed the amount you paid us for the Services giving rise to the claim during the twelve (12) months before the claim arose.
8. Termination
Either party may terminate a project or recurring service in accordance with the terms set out in the applicable proposal or service agreement. Upon termination, you remain responsible for payment for work completed and expenses incurred up to the termination date.
9. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page with a revised effective date. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles. Any dispute arising from these Terms or our Services will be resolved in the courts located in New Jersey.
